Terms & Conditions
1. Scope of Services
The scope of work shall be strictly limited to what is defined in the proposal, quotation, or agreement issued by Indradhanush.
Any work, drawing, consultation, site visit, or service not explicitly mentioned in the agreed scope shall be treated as additional work and charged separately.
Verbal discussions, WhatsApp messages, or informal suggestions shall not be considered binding unless formally documented by Indradhanush via email or drawings.
2. Fees, Payments & GST
All payments are mandatory and non-negotiable once a stage is initiated.
All payments must be made only via online banking modes (UPI, NEFT, RTGS, IMPS, or approved gateways).
Cash payments are strictly not accepted under any circumstances.
All payments must be made only to the official Indradhanush bank account shared in writing.
No payment shall be made to any employee, consultant, architect, designer, or site staff personally. Any such payment will be considered invalid.
All invoices shall be raised with 18% GST, which is compulsory and non-waivable.
Any government taxes, levies, or statutory charges applicable now or in the future shall be borne by the Client.
3. Payment Timelines & Delays
Payments must be cleared strictly as per the agreed payment schedule.
Work shall automatically pause if any payment is delayed beyond the due date.
Delayed payments may attract interest and/or late fees, and timelines will stand extended without liability to Indradhanush.
Indradhanush reserves the right to withhold drawings, site visits, meetings, and deliverables until all dues are cleared.
4. Design Timelines
All architectural and interior drawings require 45–60 working days for completion, considering design development, discussions, and revisions.
Timelines are subject to:
Timely client feedback
Prompt approvals
Payment clearance
Delays caused due to late responses, indecision, or changes by the Client shall not be attributed to Indradhanush.
5. Revisions & Changes
The project fee includes a limited and reasonable number of revisions, as deemed standard for the project type.
Any revisions exceeding the expected or agreed number shall be chargeable at 15% of the total project design fee, per revision cycle.
Major design changes after approval (layout changes, concept reversal, style change, etc.) will be treated as fresh work and billed separately.
6. Additional Area & Scope Increase
Any increase in built-up area, carpet area, floors, rooms, or functional spaces after commencement of work will result in:
Revised professional fees
Revised timelines
No additional area shall be designed or issued without written confirmation and revised fees.
7. 3D Renders, Videos & Visuals Disclaimer
All 3D views, walkthroughs, videos, and rendered images are purely representational.
Actual execution may vary due to site conditions, material availability, workmanship, lighting, and construction limitations.
2D drawings shall be considered final and binding for dimensions, execution, and construction.
Indradhanush shall not be liable for deviations if work is executed without referring to the approved 2D drawings.
8. Meetings & Communication Protocol
Office working hours: 10:00 AM – 7:00 PM
Meetings cannot extend beyond 7:30 PM under any circumstances.
All meetings (online or physical) must be booked exclusively through the official booking system on the Indradhanush app or website.
Walk-ins or unplanned meetings will not be entertained.
9. Communication Mode
Each project will have a dedicated WhatsApp group including assigned architects, engineers, or designers, clearly identified as Indradhanush Support.
Communication is encouraged to be limited, relevant, and documented.
Important instructions, approvals, or concerns must be shared via email at projects@indradhanush.com.
Lengthy discussions or repeated clarifications must be scheduled as a formal meeting via the booking system.
10. Site Visits
All site visits must be pre-booked via the Indradhanush app only.
Unscheduled or emergency site visits may be chargeable.
Additional site visits beyond the agreed number shall be billed separately.
Site visit reports will be issued within 24–48 hours of the visit.
11. Termination by Client
If the Client chooses to discontinue or terminate the project at any stage:
All completed work up to that stage shall be billed and payable immediately.
No refunds or advances shall be returned, irrespective of project stage.
Indradhanush reserves full copyright over all drawings and designs unless full payment is made.
12. Termination by Indradhanush
Indradhanush reserves the right to immediately terminate the project without refund in cases including but not limited to:
Non-payment or repeated payment delays
Abusive, threatening, or disrespectful behavior
Unauthorized recording of meetings
Breach of communication or confidentiality rules
Misuse or unauthorized sharing of drawings
13. Confidentiality & Intellectual Property
All drawings, designs, concepts, BOQs, and documents are the intellectual property of Indradhanush.
Reproduction, sharing, or use of drawings without written consent is strictly prohibited.
Clicking photographs, screen recording, or recording video/audio of meetings is strictly prohibited.
If found violating this clause, the project shall be terminated immediately with no refund.
14. Execution & Contractor Responsibility
Indradhanush shall not be responsible for workmanship, delays, or defects caused by contractors, vendors, or third parties appointed by the Client.
Site supervision does not imply liability for execution quality unless explicitly mentioned in the agreement.
15. Force Majeure
Delays or failure due to events beyond reasonable control (natural calamities, strikes, pandemics, government restrictions, etc.) shall not be considered a breach of contract.
16. Jurisdiction & Governing Law
All disputes shall be subject to the laws of India.
Jurisdiction shall be exclusively Uttarakhand, irrespective of project location.
17. Acceptance of Terms
Proceeding with payment, drawings, meetings, or site visits constitutes full acceptance of these Terms & Conditions.
Indradhanush reserves the right to modify these terms at any time without prior notice.
